These Terms govern your use of THE FACTORY (the Service), including the getthefactory.com website and the THE FACTORY desktop application. By using the Service you agree to these Terms.
THE FACTORY generates three-dimensional terrain from publicly available global elevation data for use in compatible third-party games you separately own. Free previews are available without an account.
You are responsible for activity under your account and for keeping your sign-in secure. You must provide accurate information and be old enough to form a binding contract in your jurisdiction.
Paid downloads require an active membership of 19.99 US dollars per month, billed through our payment processor, Stripe. Membership renews automatically until you cancel. You may cancel at any time and keep access until the end of the current billing period. Except where required by law, payments are non-refundable for partial periods. We may change pricing with reasonable notice.
We grant you a personal, non-exclusive, non-transferable license to use the application and the files it generates for your own gameplay. You may not redistribute, resell, or reverse engineer the application.
All software, artwork, and assets in the Service are original works owned by THE FACTORY. THE FACTORY is an independent studio and is not affiliated with, endorsed by, or sponsored by Atari, Frontier Developments, or the RollerCoaster Tycoon franchise. Those names are trademarks of their respective owners and are referenced only to describe compatibility. Generated files are intended for use with software you lawfully own.
Do not use the Service unlawfully, attempt to bypass membership controls, disrupt the Service, or use it to infringe the rights of others.
The Service is provided as is, without warranties of any kind. To the fullest extent permitted by law, THE FACTORY is not liable for indirect or consequential damages, and our total liability is limited to the amount you paid in the prior twelve months.
These Terms are governed by the laws of the State of West Virginia, USA, without regard to its conflict-of-laws rules.
We may update these Terms; material changes will be posted here with a new effective date. Continued use means you accept the updated Terms.
